Terms & Conditions
Effective as of September 10, 2026
These Terms of Service ("Terms") govern your use of the Prestige Peak Sales website and your interactions with Prestige Peak Sales ("Prestige Peak", "we", "us", or "our"). By using this website, you agree to these Terms. Paid client engagements may also be governed by a separate proposal, statement of work, service agreement, or other written agreement.
1. Website Use
You may use this website for lawful business purposes and to learn about Prestige Peak and contact us. You must not misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious code, or use it in a manner that violates applicable law or the rights of others.
2. Our Services
Prestige Peak provides business-to-business services that may include customer and prospect reactivation, outreach, follow-up, lead qualification, appointment setting, campaign administration, and reporting. The exact scope, channels, responsibilities, pricing, and service period for a client engagement will be defined in the applicable written proposal or service agreement.
3. Preliminary Communications
A website inquiry, estimate, proposal discussion, or other preliminary communication does not by itself create a client engagement. A service relationship begins only when the parties agree to the applicable commercial terms or otherwise confirm the engagement in writing.
4. Separate Client Agreements Control
If you become a client, your signed or otherwise accepted service agreement, proposal, statement of work, or similar written agreement will govern that engagement. If there is a conflict between these website Terms and a specific written client agreement, the client agreement will control for that engagement.
5. Client Customer and Prospect Data and Instructions
Clients may provide Prestige Peak with lead lists, customer or prospect records, inquiry histories, estimate information, consent or preference information, and other data for use in providing services. By providing such information or directing Prestige Peak to conduct outreach, the client represents that it has the right and lawful authority to provide the information and instruct Prestige Peak to process and use it for the agreed purpose.
Clients are responsible for the accuracy and legality of information, offers, pricing, claims, eligibility rules, contact lists, consent records, suppression lists, and other instructions they supply. Clients must not instruct Prestige Peak to send communications or process information in a way that violates applicable law, contractual obligations, or third-party rights.
6. Outreach and Canadian Compliance
Prestige Peak will use commercially reasonable efforts to follow the outreach process, qualification criteria, brand instructions, and compliance requirements agreed with a client. Depending on the communication channel and circumstances, outreach may be subject to Canadian privacy law, Canada’s Anti-Spam Legislation (CASL), CRTC telemarketing rules, and National Do Not Call List requirements. Each client remains responsible for the legality of its underlying lead sources, consent records, offers, and campaign instructions, while Prestige Peak remains responsible for its own conduct and obligations under applicable law.
7. No Guarantee of Results
Customer and prospect reactivation and appointment setting depend on factors outside Prestige Peak's control, including lead quality, age of the database, prior customer experience, market conditions, pricing, offer strength, availability, sales follow-up, and individual prospect decisions. Unless expressly stated in a written client agreement, Prestige Peak does not guarantee a specific number of contacts, responses, qualified leads, appointments, sales, conversion rates, or revenue.
8. Fees, Billing, Cancellations, and Service Changes
Fees, payment schedules, performance-based compensation, cancellation rights, service terms, and any refunds or credits will be governed by the applicable client proposal or service agreement. Website use alone does not create a payment obligation.
9. Referral Program
Where Prestige Peak offers a referral reward and no separate written referral agreement states otherwise, an eligible referrer may receive 10% of amounts actually received by Prestige Peak from a referred client, up to an aggregate lifetime maximum of CAD $500 per referred client. The $500 limit applies to the entire relationship with that referred client, regardless of how long the client remains engaged, renews, expands services, or makes additional payments.
Once the aggregate CAD $500 maximum has been paid for a referred client, no further referral commission, residual, recurring payment, or other compensation is owed in connection with that referral. Referral rewards are calculated only on amounts actually received by Prestige Peak and are not earned on amounts that are unpaid, refunded, credited, reversed, disputed, or charged back.
10. Confidentiality
During a client engagement, each party may receive non-public business information from the other. Confidentiality obligations may be set out more fully in the applicable service agreement. Prestige Peak will not intentionally disclose a client's confidential customer and prospect database to unrelated third parties except as necessary to provide the services, as authorized by the client, or as required by law.
11. Intellectual Property
The Prestige Peak name, branding, website design, copy, graphics, and other materials created by or for Prestige Peak are owned by Prestige Peak or used under licence and may not be copied, reproduced, or commercially exploited without permission, except where allowed by law. Clients retain ownership of their own data, trademarks, materials, and content supplied to Prestige Peak.
12. Third-Party Services
Our website and services may rely on or link to third-party platforms such as Shopify, email providers, CRM systems, communications tools, analytics providers, and other software. Those services are governed by their own terms and policies. Prestige Peak is not responsible for outages, changes, or acts of third-party services outside our reasonable control.
13. Disclaimer
To the maximum extent permitted by law, the website and general website information are provided on an "as is" and "as available" basis. We do not warrant that the website will always be uninterrupted or error-free. Business and marketing information on this website is general information and is not legal, financial, or professional advice.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Prestige Peak will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of this website or from matters outside the agreed scope of a client engagement, including lost profits, lost opportunities, or loss of data. Any additional limitations applicable to paid services may be set out in the applicable client agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of this website, your violation of these Terms, or—if you are a client—your provision of data, claims, offers, consent records, or instructions that you were not legally entitled to provide or direct. Engagement-specific indemnity obligations may be addressed in the applicable client agreement.
16. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles. Subject to any dispute-resolution terms in a separate client agreement, disputes relating to these website Terms will be subject to the courts of British Columbia.
17. Changes to These Terms
We may update these Terms from time to time. A revised version will identify the date on which the new Terms become effective.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
